GENERAL CONDITIONS OF SALE

These General Conditions of Sale are intended to define the rules applicable within the framework of the sale of Apostrophe branded products (hereinafter “the Product(s)”) on the Site www.apostrophe-paris.com

ARTICLE 1 • PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the conditions under which the Products are marketed by Apostrophe SA to the Customer. They thus regulate the various stages of completion of the sale from the placing of the order by the Customer.

ARTICLE 2 • PRODUCTS

The Products offered for sale by Apostrophe SA are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the photograph, the sizes and colors available, the composition, as well as the particular characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user's screen.
Apostrophe undertakes to deliver Products that meet the requirements in force relating to the safety and health of people in accordance with European provisions, and in particular the legislation on regulated chemical substances.

ARTICLE 3 • PRICE

Prices are indicated in euros, all taxes included , excluding delivery costs; it being specified that the value added tax is that in force in metropolitan France on the day the order is validated.
The prices applied are those communicated on the Site and confirmed to the Customer when the order is validated.
The delivery costs are communicated to the Customer on the order summary before the validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products. The transfer of the risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer. We reserve the right to modify our prices at any time but we undertake to apply the rates indicated on the Site at the time of your order. We inform you that in the event of the display of an incorrect price, clearly derisory (low price), whatever the reason (computer bug, manual error, technical error.), the order - even validated by us - will be cancelled, of which we will inform you as soon as possible. You will then be able, if you wish, to reorder at the corrected and exact price.

ARTICLE 4 • ORDERING AND PAYMENT OF PRODUCTS

  • 4.1 Placing an order

The Customer completes his order by completing the following 5 steps:
Step 1: The Customer selects the chosen Products and adds them to his basket after having selected the desired size and color.
The basket located at the top right of the screen informs the Customer that it has taken the selections into account by indicating the number of Products it contains.
Step 2: The Customer checks the contents of their basket by clicking on "order" in order to access the summary of their order. The Customer can then modify their order (Product, size, quantity).
The total amount including tax of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.
Step 3: once the order has been checked and modified if necessary, the Customer validates their basket in order to finalize their order by clicking on “order” again.
If the Customer has an advantage code, reserved for the best Customers, he must enter it in the space provided for this purpose in order to benefit from it.
Step 4: Customer enters delivery and billing details
Except for the date of birth, the address supplement and the delivery information, all fields are necessary to finalize the order; it being specified that unless otherwise indicated by the Customer, the billing address will automatically be the same as the delivery address.
If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his email address and password.
The Customer then checks all the information and clicks on “validate” to continue with their order.
Step 5: Enter your bank details
The Customer will then access the Apostrophe secure payment screen as specified in Article 4.3 below. Payment is made online by credit card only.
The Customer must enter their bank card number, its expiry date and the 3 numbers of the visual cryptogram on the back of their card, it being specified that in the case of payment by American Express card, the Customer must provide 4 digits.
If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

  • 4.2 Confirmation of the order

Upon acceptance of the Customer's payment, the Customer will receive an email confirming their order, summarizing all the items ordered, the billing and delivery address and the delivery date.
The validation of the order by the Customer and the order confirmation sent to the Customer by email following acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale.
The Customer having placed an order will have the possibility of printing his invoice by connecting to the Site in the order tracking area provided for this purpose.
Apostrophe reserves the right not to validate the order in the event of:

  • abnormal or abusive claims,
  • abnormal orders in relation to the quantities ordered,
  • abnormal or abusive exchanges and returns,
  • existing dispute(s) with the customer.

The Apostrophe website customer service is available to the Customer for any questions relating to their order. Customer service is available by email (help@apostrophe.fr ), and by telephone at 01 42 21 90 73, from Monday to Friday, from 9:30 a.m. to 5:30 p.m.

  • 4.3 Payment

The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer. Payment is made online by credit card (Carte Bleue, Visa, Eurocard/Mastercard/American Express) at the time the order is validated by the Customer.
The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. Apostrophe reserves the right to make a new request for authorization to debit in the event that the first could not be completed due to unavailability of the servers.

In the event of non-payment, an incorrect address or any other problem with the Customer's account, Apostrophe reserves the right to block the Customer's order until the problem is resolved.
In the event of fraudulent use of his bank card on the Site, the Customer is invited to contact Apostrophe customer service at the following number: 01 42 21 90 73 from Monday to Friday from 9:30 a.m. to 5:30 p.m. or by email at the following address:help@apostrophe.fr .
Apostrophe implements all necessary means to ensure the confidentiality and security of banking data transmitted on the Site. The Site is equipped with an online payment security system that encrypts your banking data. Payment information is transmitted according to the highest security standards.
All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through Apostrophe's computer system.

  • 4.4 Archiving the order

The order confirmation is recorded in Apostrophe's records, which are themselves stored on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

ARTICLE 5 • DELIVERY

Apostrophe will deliver orders accompanied by a delivery note within a maximum of ten (10) working days for delivery to Metropolitan France, and twenty (20) working days for delivery to any other destination, starting from the day following payment of the order.
Any order placed on the site will be processed from the day following the order. Any order placed on Friday, Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the following working day.
In the event of the delivery time being exceeded, not justified by a case of force majeure, the Customer may request the cancellation of the sale and obtain within a maximum period of 15 days the reimbursement of the sums paid on the occasion of the sale.
For orders outside France, when the package intended for export reaches its destination, it will be the recipient's responsibility to pay the taxes or customs duties that apply to the destination country. The local authorities can provide you with useful information.

ARTICLE 6 • RECEIPT OF THE ORDER – COMPLAINTS – RETURNS

The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery such as:

  • damaged package,
  • missing products,
  • damaged products,
  • products not conforming to the order,

Must be notified within the legal time limits following receipt of the order. This notification will be sent to the Apostrophe website customer service either:

  • by registered mail, writing to the following address: CUSTOMER SERVICE – 26 rue Bayard, 75008 Paris.
  • by email to help@apostrophe.fr

After this period, and except for hidden defects, no claims will be accepted by Apostrophe, the Products then being deemed compliant.

For any return of a non-compliant Product outside the dates previously stated, the Customer must follow the following procedure:

  • The Customer must enclose with his package the return slip previously completed and printed using the return form accessible on the 'return slip' page. No return will be accepted without said return slip duly completed.
  • The Products must be returned either in their original packaging or in packaging protecting the product against any deterioration, with their label and any accessories allowing their remarketing, to the following address:

  • Returns or exchanges will not be accepted in store.
  • The risks and costs of return are the exclusive responsibility of the Customer.

When non-conformity has been noted, Apostrophe will offer the Customer a refund of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-conforming Product, at the latest within 15 days from the date of sending the notification of confirmation of the non-conformity by the customer service of the Apostrophe site.
In the event of a refund, Apostrophe will reimburse all products returned to conformity, with the exception of taxes and customs duties paid by the customer upon delivery. Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, Apostrophe will reimburse the postal return costs up to the price list (Colissimo delivery without registered mail) displayed by La Poste on March 1 of the current year. The Customer must send proof of the return costs incurred to Customer Service by email. In the event of abnormal or abusive complaints, Apostrophe may refuse to serve a subsequent order.

ARTICLE 7 • RIGHT OF WITHDRAWAL

The Customer has a period of 15 working days from the date of receipt of his order to return the Products ordered, without justification or penalty.
For any return under the right of withdrawal, the procedure below must be fully followed:

  • The Customer must enclose with his/her package the return form previously completed and printed using the return form accessible from the customer area - “My Orders” section. No return will be accepted without said return form duly completed.
  • The Products must be returned in their original packaging, with their label and any accessories, in perfect condition to:

  • The risks and costs of return are the sole responsibility of the Customer. Subject to the conditions mentioned above, Apostrophe will reimburse the amount including tax of the order to the Customer (price of the Product and delivery costs) excluding return costs. The Customer's bank account will be credited with said amount, within 15 days from receipt of the Products by Apostrophe.

ARTICLE 8 • PERSONAL DATA

Apostrophe collects a certain amount of information necessary for processing orders.
This data is not only necessary for Apostrophe to process the Customer's order, but also to communicate information to the Customer about the Apostrophe brand, on the Site or to provide them with Apostrophe commercial offers; if the Customer accepts it by validating their order.
The information is strictly confidential and is marked with an asterisk (*) when it is necessary for Apostrophe, and/or its service providers in the context of managing the Customer's order.
Following any injunction from legal authorities or in order to defend its rights or those of its employees, customers or any other person, Apostrophe may communicate this data to legally authorized organizations and authorities.
Apostrophe undertakes to take all useful precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Client's personal information from being distorted, damaged or accessed by unauthorized third parties.
In accordance with the "Informatique et Liberté" law of January 6, 1978, as amended by the law of August 6, 2004, the Client has the right to access, rectify, modify and delete data concerning him/her.
The site is declared to the National Commission for Information Technology and Civil Liberties - CNIL under number 1351361. The Customer may exercise this right by sending a letter to the following address or by email, specifying his/her surname, first name, email and postal address:

The Customer can also modify their personal details from their customer area by logging in using their email address and password.

ARTICLE 9 • COOKIES

In order to process the Customer's order, and in order to better understand their needs and personalize the services offered on the Site, Apostrophe uses cookies. A cookie is a computer file, stored on the hard drive of the Customer's microcomputer, which is intended to signal their visit to the Site.
Cookies store the Customer's visit time on the Site, their identity (known by their email address and password) and the contents of their shopping cart. Once disconnected from the Site, this information is stored for 30 (thirty) days before being permanently deleted.
The Customer may oppose the recording of cookies by configuring his Internet browser. He then loses all personalization of the service offered to him on the Site.

ARTICLE 10 • LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or transfers of information, risks of disconnection, risks of contamination by viruses circulating on the network and, in general, all risks linked to the use of the Internet network.
Apostrophe may therefore not be held liable under any circumstances for any direct or indirect damage resulting from improper use or incident related to the use of the computer, Internet access, maintenance or malfunction of the servers, the telephone line or any other technical connection, the Client's connection to the Site being made under his/her entire responsibility.

ARTICLE 11 • FORCE MAJEURE

Apostrophe will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if this non-performance is caused by an event constituting a case of force majeure as defined by positive law.
In such a case, Customer Service will inform the Customer of the occurrence of such an event within 3 (three) clear days following its occurrence, by email.
After a period of 1 month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, where applicable, will be subject to a refund from Apostrophe to the bank card used to place the order within a maximum period of 15 days.

ARTICLE 12 • APPLICABLE LAW

If any of the terms of these General Conditions of Sale are found to be null and void, illegal or unenforceable by a court decision, the other provisions of the General Conditions of Sale shall remain in force.
The General Conditions of Sale are executed and interpreted in accordance with French law.
In the event of a dispute, the customer will contact Apostrophe as a priority to obtain an amicable solution and, failing agreement, the ordinary courts will have sole jurisdiction.
